A Family Systems Approach to Mediation with Families in Transition

The work shows how family systems approach could be used by mediators, both to understand structural changes of families passing through separation and divorce, and to help comunicative exchanges inside the new reconstructed family systems, promoting cooperation and supporting the maintenance of a parental relationship between parents. It’s exemplified the “ecogram” method, a modified version of genogram, that make it possible to understand the ecology of the evoluting family system and structure. Functions and strategies that a mediator should use to help family pass through these periods of transition are briefly illustrated.

This work defines and analizes reconstructed family’s structure and the problem of shared parental fuction.
When we meet children or adolescents whose parents are separated, we should deal with familiy systems differing from the classic nuclear family (father – mother –child). Taking responsability for separating or reconstructing families does set the issue of the parental fuctions’ sharing. Which are the parental fuctions leading our young patients’ education? Which are our representations of these new family structures?
In the practice, the young patients are invited for a talk with their involved family members and more generally with all the parental fuctions around them. Each reconstructed family will present a different situation, in which biological, legal and affective functions could be shared by more different persons. These situations need a new representation of family structure and an action adjusted in a specific way to each system. Some theorical concepts about this problem will be presented and some elements of therapeutic practice will be illustrated through two clinical cases.

Particularly in family mediation, the exchange between reciprocal expectations, that base the couple’s joint, could jeopardize the achievement of a good agreement on the parental level and especially its practical fulfilment. In this work, we explore the way through which two subjects non autonomous could be led toward a position of sufficient freedom to face the common problems concerning the family system’s reorganization. If this doesn’t happen, important issues remain open so that it’s not possibile, in case of breaking, the passage to psichological separation, an essential condition to protect the parental relationship. This contribution complains about the legislative vacuum characterizing new intellectual professions so-called non-regulated, and tries to give a juridical-formative and psychosocial contest tha, in some way, could consider the normative and paranormative aspects following marriage and separation.
The work’s authors, after defining the areas in which the mediation process is applied: juridical and psichosocial, underlining, in a comparative and synoptic frame, the self-regulating rules in use in the different mediation professional societies and framing the issue inside the civil regulations existing about the practice of intellectual professions relatively to the exact fulfilment of the obligation of means and not of result, opening the reflection about future possible scenery.

TThis work starts from the analysis of children’s experiences in the conflict between separating parents. Children are in the middle of the conflict, doing functions, having inner wishes but also strong wills, not always conscious. Recent legislation in matter acknowledges to the underage the right to be heard in any proceeding involving him directly. This is not simple and dangerous, even for the specialists. On one side there is the necessity to hear their wishes, on the other to understand that wishes’ meaning. Listening to the underages in the family mediation context means therefore helping the parents to understand the realtionship between them and their children in this exact time of their life, so to make their words and their wishes comprehensible.
Here we describe a methodology using the “Lousanne Triadic Play” and videotaping. Besides acknowledging the child’s active role in the family dynamics, and his right to be heard and to partecipate, ratified by law, this methodology also represents an effective technique to be used by mediators helping the couple to keep on being parent together.

Lorsque on rencontre des enfants ou des adolescents dont les parents sont séparés, on est confronté à des systèmes familiaux différents de la famille nucléaire habituelle (père – mère – enfant).
La prise en charge des familles en voie de séparation ou de recomposition pose la question du partage des fonctions parentales. Quelles sont les fonctions parentales qui assument l’éducation de nos jeunes patients? Quelles sont nos représentations de ces nouvelles structures familiales ? Nos jeunes patients sont invités pour une consultation ainsi que les membres de sa famille qui sont concernés et en tous cas les fonctions parentales qui l’entourent. Chaque famille recomposée present a different situation where the biological functions, legal and emotional can be spread over different people. These situations involve a new representation of family structures and suitable work with each of these systems.
